Department of Pesticide Regulation lists top 5 agricultural pesticide use violations for 2017

Most common violations stem from not following label directions

The California Department of Pesticide Regulation recently released its top-five most common agricultural pesticide use violations of 2017.

According to the Fresno County Department of Agriculture, these common violations of pesticide laws and regulations can be found in Divisions 6 and 7 of the Food and Agricultural Code (FAC) and in Title 3 of the California Code of Regulations (3CCR).

They are, in descending order:

  • 5 – Registration: FAC section 11732
    Not registering with the county you intend to work prior to performing pest control activities.

  • 4 – Application Specific Information for Fieldworkers: 3CCR section 6767.1
    Not including the application start and stop times, REI, or active ingredient in the displayed information. Not displaying the Application-Specific Information before fieldworkers work in a treated field.

  • 3 – Emergency Medical Care: 3CCR section 6726
    Not taking employees suspected of a pesticide illness to the doctor immediately. Not posting the name, address, and phone number of the medical facility at the worksite or in the work vehicle before employees begin handling pesticides.

  • 2 – Personal Protective Equipment (PPE): 3CCR section 6738
    Storing PPE in the same place pesticides are stored. Not cleaning PPE and checking for wear after each use.

  • 1 – Recommendations and Usage: FAC section 12973
    Not following label-required buffer zone, set back distance, or vegetative buffer strip requirements. Applying a pesticide to a site or crop not listed on the labeling
