Mike Pearson tells listeners how Proposition 12 might be headed to the U.S. Supreme Court.
Last year, the Supreme Court upheld Proposition 12 after the American Farm Bureau Federation and the National Pork Producers Council appealed it.
The law, Proposition 12, requires that any pork sold in California -- no matter where it was raised had to comply with California's housing standards
Proposition 12 requires that each pig must have 24 square feet of usable floor space.
The hogs must be able to standup, turn around, lie down and stretch out.
Proposition 12 is being appealed under the Dormant Commerce Clause which means it puts an undue burden on commerce.
It's the latest challenge with a different approach.
The Iowa Pork Producers Association along with 23 state attorney generals are making the appeal.
The appeal basically says Proposition 12 discriminates out of state pork producers. It zeroes in on whether California is imposing it's policies on other states.
The Supreme Court has been willing to intervene in cases that involve in-state interest vs. out of state competitors which makes it possible it will take the Proposition 12 up as a case.
